Terms and cancellation conditions
Last updated: January 2026 — in accordance with the Swiss Federal Act on Package Travel (PTA, SR 944.3) and art. 184 ff. of the Code of Obligations.
1. Contracting parties
The travel contract is concluded between the customer and Rosy Viaggi, with registered office at Via Laveggio 4/A, 6855 Stabio (Switzerland). The agency acts as an organiser of package travel within the meaning of the PTA.
2. Conclusion of the contract
The contract is concluded upon written confirmation by Rosy Viaggi and payment of the deposit. On booking, the customer receives the documentation containing all the mandatory information required by the PTA.
3. Prices and payments
- 30% deposit on booking;
- balance no later than 30 days before departure;
- for bookings made less than 30 days before departure, full payment is due on confirmation.
Prices are stated in Swiss francs (CHF) and include the services expressly indicated in the trip description.
4. Changes to the price and the programme
In accordance with art. 6 PTA, Rosy Viaggi reserves the right to change the price (in the event of variations in transport costs, fuel, exchange rates or taxes and charges) up to 21 days before departure. Increases of more than 10% entitle the customer to withdraw from the contract free of charge.
5. Cancellation by the customer
If the customer withdraws from the trip, the following charges apply, calculated on the total price (PTA art. 10 and CO art. 377):
- up to 60 days before departure: 10% (administration fee);
- from 59 to 30 days: 30%;
- from 29 to 15 days: 50%;
- from 14 to 7 days: 75%;
- from 6 days to the day of departure or in the event of a no-show: 100%.
Cancellations must be communicated in writing (email or registered letter). The date of receipt by Rosy Viaggi is decisive.
6. Cancellation insurance
We recommend taking out cancellation insurance as well as assistance and baggage insurance. Unless expressly included in the package, insurance is at the customer's expense and must be taken out at the time of booking.
7. Cancellation by the organiser
Rosy Viaggi may cancel the trip if the minimum number of participants is not reached (notice at least 20 days before departure) or in cases of force majeure. In such cases the customer is entitled to a full refund of the amounts paid, with no further compensation.
8. Travel documents
The customer is responsible for holding valid identity documents, visas and health formalities required by the destination country, both for Swiss and for Italian nationals. Rosy Viaggi is not liable for a trip not taken due to non-compliant or expired documents.
9. Liability
The liability of Rosy Viaggi is governed by art. 14 ff. PTA. We are not liable for failures attributable to the customer, to third parties unconnected with the service or to force majeure.
10. Complaints
Complaints must be reported on site to the tour leader and submitted in writing to Rosy Viaggi within 30 days of the return date. Late complaints cannot be taken into consideration.
11. Place of jurisdiction and applicable law
This contract is governed by Swiss law. The exclusive place of jurisdiction is the Court of Mendrisio (Canton of Ticino), subject to the mandatory place of jurisdiction for consumers.
